What is an AFSS?
The AFSS ensures that all essential fire safety measures set out in the fire safety schedule for the building have been inspected by a competent fire safety practitioner and are in working order, capable of performing in case of fire. An AFSS is a declaration by the building owner(s) or agent that the essential fire safety measures have been tested and meet the required standard of performance.
Which Legislation Applies in NSW?
Under Environmental Planning and Assessment Regulation 2000 (EP&A Reg.), clause 177 states that a building owner must provide the council with an annual fire safety statement which deals with each essential fire safety measure in the premises. The AFSS must also be given to the Fire Commissioner and prominently displayed in the building. Heavy fines apply when AFSS is late.

Whose Responsibility Is It?
The building owner(s) or their agent is ultimately responsible for the fire safety statement process. It is the building owner(s) or agent’s responsibility to select a competent fire safety practitioner who is accredited with FPAS to undertake an assessment of each fire safety measure.
